About this Case:
TMLG has filed suit on behalf of Whidbey Island homeowners against Windermere Real Estate for allegedly failing to notify buyers of the noise associated with U.S. Navy aircraft operation. Plaintiffs Jonathan Deegan and Alice O’Grady purchased property on Whidbey Island, but did not receive the required noise disclosure from the Defendants that includes detailed information about the jet engine noise from tactical military jet aircraft facilities. All buyers are entitled to this notice so they can make informed decisions before purchasing their homes. Plaintiffs allege that this failure to disclose by the Defendants violates the Washington State Consumer Protection Act and Island County’s Airport and Aircraft Operations Noise Disclosure Ordinance.
