Avvo Wage and Hour Lawsuit

On March 15, 2016, Terrell Marshall Law Group and The Hanley Law Firm filed a lawsuit against Avvo, Inc. to recover overtime pay on behalf of current and former employees who have worked as Account Executives for the company during the past three years. Avvo is an online legal services marketplace based in Seattle. The primary responsibility of its Account Executives is to engage in sales through outbound calls to attorneys and law firms. Plaintiffs Cody Tolliver, Jamal Barnett, and Kyle Clementz allege Avvo unlawfully classifies these employees as exempt from Washington’s Minimum Wage Act, which requires employers to pay workers 1.5 times their regular rate of pay for all hours worked over 40 in a workweek. Plaintiffs allege Account Executives regularly work more than 40 hours per week, but Avvo willfully fails to pay overtime compensation because of the unlawful classification. Under Washington law, an employer that willfully fails to pay earned compensation is liable for twice the amount of wages owed.
