On June 16, 2016, the Skagit County Superior Court granted final approval to a class action settlement reached in Witschel v. IMCO General Construction, Inc. The lawsuit alleged that IMCO General Construction violated Washington’s rest break laws in relation to their hourly construction workers. While denying liability, IMCO agreed to pay $1.1 million to settle all claims.
Washington requires employers to provide workers with paid, ten-minute rest breaks for every four hours worked. When an employer fails to provide rest breaks, state law mandates compensation for the additional time worked.
Class members in this case include all current and former non-managerial and non-supervisory hourly paid construction craft employees of Defendant IMCO who worked for the company in Washington between January 1, 2009 and November 10, 2014.
If no appeals are filed, checks to class members should be issued by the middle of August 2016. The plaintiff and class members are represented by Toby Marshall of Terrell Marshall Law Group PLLC.
