About this Case:
TMLG represented a class of drivers who delivered packaged for FedEx Ground Package System, Inc. (“FedEx Ground”) but were paid by a separate entity – FedEx Ground Contracted Service Providers (“Contracted Service Providers”). The drivers claimed that FedEx Ground was a joint employer with Contracted Service Providers, and that as a joint employer, FedEx Ground was liable for failing to pay the drivers overtime compensation when they worked over 40 hours per week and for failing to provide meal and rest break periods.
