Pagliacci Pizza Class Action

About this Case:

Pagliacci Pizza, Inc. is a pizzeria chain that employs hundreds of employees at dozens of locations in the greater Seattle area. Pagliacci presents itself as a “successful local company that knows how to take care of its customers and employees.” But, as Plaintiff Stephen Burnett found out, Pagliacci does not take care of its employees.

Mr. Burnett delivered pizzas for Pagliacci from 2015-2017. During that time, he claims that Pagliacci regularly violated Washington wage and hour laws. He claims that Pagliacci did not provide him with rest or meal breaks, did not pay him all the tips that he had earned, made illegal deductions from his pay check, and did not pay for automobile expenses as required by Washington law. Mr. Burnett filed suit to correct these wrongs on behalf of himself and a class of Washington residents who were employed by Pagliacci from October 3, 2014 to present.

Case Status

The Washington Supreme Court issued an opinion August 2020 ruling that Steven Burnett is not required to arbitrate his claims and can proceed with his proposed class action in King County Superior Court.
