About this Case:
Jonathan Rosario applied and interviewed for a barista position at Starbucks. After the interview Starbucks made a conditional offer of employment to Mr. Rosario and then requested a background check from Accurate Background. Starbucks also requested that the background check include the Accurate Background’s adjudication of whether Mr. Rosario was eligible for employment at Starbucks. The background report prepared by Accurate Background included inaccurate criminal record information pertaining to Mr. Rosario’s brother and also adjudicated Mr. Rosario as ineligible for employment at Starbucks. As a result, Starbucks removed Mr. Rosario from the hiring pool. Mr. Rosario brought a class action against Starbucks alleging that this standard practice violates the Fair Credit Reporting Act because Starbucks did not provide Mr. Rosario with notice before taking adverse action against him.

Case Status: On July 15, 2020, the Northern District of Georgia granted final approval of a settlement that provides class members up to $8 million in benefits.
