Capital One Robocall TCPA Class Action

About this Case:

Plaintiffs allege that Defendant Capital One knowingly and willfully contacted them on their cellular telephones using an automatic telephone dialing system or a prerecorded voice without their prior express consent, violating the Telephone Consumer Protection Act, 47 U.S.C. Section 227 (“TCPA”). This is a nationwide class action. Defendants deny that they did anything wrong, or that this case is appropriate for treatment as a class action.

Case Status:

This case was filed in February 2013. The parties reached a settlement on June 12, 2014. The Court did not decide in favor of the Plaintiffs or Defendants. Both sides agreed to a settlement instead of going to trial. A Northern District of Illinois court granted final approval of the settlement on February 23, 2015. Although several objectors appealed the district court’s order approving the settlements, all of the appeals have been dismissed. The Claims Administrator mailed initial settlement payments by August 7, 2015 to all class members who submitted timely, valid claims.
