Ben brought his passion for justice to Terrell Marshall Law Group in 2017. Before joining Terrell Marshall, he served as law clerk to the Honorable Robert H. Whaley in the Eastern District of Washington, and to the Honorable Thomas S. Zilly in the Western District of Washington. 

Ben fell in love with the Pacific Northwest after growing up on the east coast. He often spends his weekends taking long walks around Seattle with his wife, children, and their two dogs. In the time he has left, Ben enjoys skiing, playing basketball, and watching Seattle sports. 

Representative Matters

TCPA Class Actions

Hoffman v. Hearing Help—Filed in 2019 on behalf of consumers who received telemarketing calls on their cellular and residential telephones without their prior express consent. The Western District of Washington granted final approval of the $1.3 million settlement on January 5, 2022.

Consumer Class Actions

Doe v. Meta Platforms, Inc.--Together with co-counsel, TMLG filed this action against Meta in June 2022 on behalf of Facebook users whose health information was obtained by Meta from their healthcare provider through Meta Collections Tools. The proposed class action is currently pending in the Northern District of California.

Tokarski v. Med-Data, Inc.Filed in 2021 on behalf of individuals affected by a Med-Data data breach, and who were not advised of the breach in a timely manner. The Northern District of Texas granted preliminary approval of the $7,000,000 settlement on February 6, 2024.

Fealy v. Sound Credit Union—Filed in 2020 on behalf of Washington members of Sound Credit Union who were overcharged for collateral protection insurance. The Pierce County Superior Court granted final approval of the $750,000 settlement on September 16, 2022.

Blakenship v. HAPO Community Credit Union—Filed in 2019 on behalf of Washington members of HAPO Community Credit Union who were charged improper overdraft and NSF fees. The Benton County Superior Court granted final approval of the $4.5 million settlement in 2022.

Doe v. Virginia Mason—Filed in October 2019 on behalf of medical center patients whose identities and confidential communication were routed to third-party digital marketing companies. The patients allege that the medical center transmitted data from its internal internet systems using sophisticated bugging programs designed to escape detection. The King County Superior Court certified the Class on September 27, 2021, and Defendants’ request for discretionary review was denied by the Washington State Supreme Court on March 8, 2023. The class action is pending before the King County Superior Court and is set for trial in 2024.

Long v. First Resolution Investment Corporation—Filed in 2018 on behalf of Washington consumers against whom a debt buyer and its collection agency law firm obtained judgements when the debt buyer was not licensed as a collection agency. The King County Superior Court granted final approval of a settlement providing $600,000 and over $20 million in debt relief on August 28, 2020.

Miller v. P.S.C., Inc.—Filed in 2017 on behalf of Washington consumers who alleged P.S.C. filed lawsuits against them using unlawful debt collection forms. The Western District of Washington granted final approval of a settlement that provided injunctive relief and $1.52 million on January 10, 2020.
