Business Litigation

We represent clients in complex business litigation involving businesses of all sizes and types, with an emphasis on contract disputes, business tort litigation and disputes over corporate governance. Our business litigation practice includes the following types of cases:

Class Actions

Our class action attorneys prosecute class and collective actions on behalf of employees, consumers, investors, and other individuals against defendants ranging from small local businesses to Fortune 500 companies. The team includes Washington attorneys Beth Terrell, Toby Marshall, Jennifer Rust Murray, Mary Reiten, Marc Cote, and Erika Nusser. Ms. Terrell and Ms. Murray are also licensed in California and Oregon, respectively, and all of the attorneys work with co-counsel across the country to vindicate their clients’ rights.

Commercial Litigation

Our attorneys have represented businesses and individuals involved in a wide range of commercial disputes including breach of contract, non-compete and non-solicitation agreements, product liability, construction, insurance coverage, limited liability company (LLC) disputes, shareholder disputes, partnership disputes, debtor-creditor actions, profit distribution disputes, and disputes involving security interests.

Consumer Protection

Consumer protection statutes are powerful tools for protecting individual consumer rights. These statutes provide potential remedies to individual injured by conduct ranging from bad faith by insurers to deceptive marketing by corporations to the manufacture and sale of defective products. The policy behind state consumer protection statutes, including Washington’s Consumer Protection Act, favors liberal construction in order to protect the public from unfair and deceptive practices by both deterring such conduct and providing individuals with remedies when they are injured by such conduct. Our class action attorneys have fought for consumers’ rights, combating various types of consumer fraud, challenging companies who sell products that are unsafe or don’t work, and pursuing relief for consumers who have received unlawful “robocalls.”

Insurance Litigation

At TMLG, we have extensive experience litigating cases involving insurance coverage and negotiating with insurance carriers. Our practice includes representing people and small businesses that have been denied policy benefits on legitimate insurance claims in a variety of contexts, including landslides, floods, drainage problems, sewage back-ups, construction defects and other cases involving commercial general liability (CGL) insurance. We also represent individuals who are denied benefits in cases involving personal injury and medical malpractice. Typically, these cases involve failure to investigate claims, failure to pay policy limits, and failure to settle or defend.

Probate and Trust Litigation

Spearheaded by experienced litigator Adrienne McEntee, TMLG’s Probate and Trust Litigation Team represents individuals in a variety of trust and estate disputes, including actions to invalidate wills or trusts, actions by or against personal representatives or trustees, and disputes regarding the financial abuse of elders or other vulnerable adults.

In Washington, the Trust and Estate Dispute Resolution Act (known as “TEDRA”) provides a framework for the efficient resolution of disputes involving probate administration and trust management, through mediation, arbitration, express agreement, and if necessary, trial. Under TEDRA, our attorneys have successfully represented a spectrum of clients, including beneficiaries of wills and trusts, surviving spouses, and vulnerable adults.

Real Property

At TMLG, our attorneys have broad experience in real estate litigation, including disputes arising from the sale or purchase of commercial or residential real estate, the negotiation and preparation of commercial leases, title issues, financing and construction, and all related litigation. We have handled many matters involving easements, public roads, leases, CC&Rs, real covenants and servitudes, LID formation and protests, broker liability, title insurance, property insurance claims and coverage, land use issues (including shoreline substantial development permits, building permits, variances, upzoning, and “grandfathered” buildings and uses), timber trespass, adverse possession and prescriptive easements, and foreclosures and workouts. Our Real Estate practice includes the representation of developers, homeowners, title companies, escrow agents, developers, landlords, tenants, contractors, and condominium and homeowners’ associations. We provide cost-effective representation by anticipating legal problems and resolving them efficiently.

Sexual Abuse

At TMLG our attorneys have devoted many hours to helping victims of sexual abuse vindicate their rights. We specialize in prosecuting cases on behalf of women abused by health care professionals, including doctors, physical therapists, and massage therapists. Our attorneys have been very successful advocating on behalf sexual abuse victims, notably settling an action on behalf of approximately 60 female patients who were sexually harassed and abused by their physical therapist.

Our attorneys provide years of experience prosecuting wage and hour class and collective actions and have a proven track record of vindicating employees’ rights through the class and collective action process.
