Terrell Marshall and Krutch Lindell File Civil Rights Lawsuit Against SCORE Jail and NaphCare, Inc.

Terrell Marshall Law Group and Krutch Lindell Bingham Jones have filed a lawsuit in the U.S. District Court for the Western District of Washington relating to the death of Damaris Rodriguez at SCORE Jail in Des Moines, Washington. The lawsuit names both SCORE and NaphCare Inc.—a company providing contract medical services at the jail—as defendants.

Damaris was a 43-year-old mother of five with no criminal history. She was arrested and booked into SCORE jail after her family called 911 to obtain medical assistance for Damaris while she suffered from a mental health episode in her home. Unfortunately, the police arrived before medical personnel and took her to jail, rather than a hospital.

Rather than obtaining medical treatment, SCORE booked Damaris into jail and placed her in solitary confinement for four days while she suffered from extreme psychosis. Damaris was held in inhumane conditions and inexplicably denied access to medical treatment. She did not eat and barely slept while in custody, which eventually led to fatal ketone and sodium levels. She was never transported to a hospital, never saw a doctor, and eventually stopped breathing and died on the evening of January 3rd or early morning of January 4th, 2018.

The complaint alleges causes of action for several civil rights violations, violations of the American with Disabilities Act, assault and battery, negligence, and violations of Washington’s Public Records Act.

Damaris is one of numerous individuals that have suffered preventable deaths at SCORE and under NaphCare’s care. The pattern of deaths shows an extreme disregard for the constitutional rights of inmates, in addition to their health and safety.
