About this Case:
TMLG represents a class of drivers who provided services for FedEx Ground Package System, Inc. (“FedEx Ground”) as package delivery drivers but were paid by FedEx Ground Contracted Service Providers. In this case, the drivers alleged that FedEx Ground was a “joint employer” of the drivers who delivered packages for the company even though the drivers were paid by Contracted Service Providers who had signed an Operating Agreement with FedEx Ground.
The drivers claim that, as a joint employer, FedEx Ground violated Washington state wage and hour laws by failing to pay overtime compensation when drivers worked over 40 hours in a week and failing to affirmatively provide meal and rest breaks.
FedEx Ground denied the claims, but the parties reached a class action settlement. A King County Superior Court Judge approved the settlement on December 2, 2016.
