About this Case
Four former Washington in-home caregivers represented by TMLG filed suit against Home Care of Washington, Inc. (“HCOW”), alleging that the company failed to pay its employees the overtime rate required by Washington’s Minimum Wage Act, failed to play to pay its employees for the time they spent traveling between clients and coerced employees to work off the clock. Plaintiffs claimed that, when employees could not complete their work within the scheduled time, HCOW either altered their timecards to delete the extra time or pressured caregivers to underreport their time. Plaintiffs further alleged that they were not compensated for the time spent performing administrative tasks for HCOW. Defendants denied Plaintiffs’ claims. After more than 8 years of litigation, the Parties reached a settlement in December of 2014. The thousands of homecare workers who benefited from the settlement were predominantly minimum wage earners who worked tirelessly caring for elderly and disabled people in central and eastern Washington.
Case Status
Judge James Triplet of Spokane County Superior Court approved the settlement on January 30, 2015. In order to receive payment, class members were required to submit a claim form by January 7, 2015. Settlement checks were mailed to all of the claimants in March 2015.
