About this Case
TMLG has filed a class action lawsuit on behalf of policyholders against health insurer Premera Blue Cross for knowingly allowing a data security breach, which resulted in the theft of confidential information. The breach compromised the clinical information, banking account numbers, Social Security numbers, birth dates, and other data of millions of customers. Under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), Defendant Premera is accountable for safeguarding the personal information of its customers. We believe that Premera failed to implement cyber security measures by not encrypting data and failing to heed warnings from federal auditors regarding the inadequate security of their systems. Despite acknowledging notification of the breach on March 17, 2015, Premera has yet to inform all potentially affected policyholders.
