About this Case
Terrell Marshall Law Group PLLC filed a collective action on behalf of call center employees working for Xerox Business Services, LLC and Affiliated Computer Services, Inc. (ACS). The complaint alleged that Xerox and ACS violated the Fair Labor Standards Act (or FLSA) because they did not pay their call center employees for all hours worked. Over 3,300 class members opted-in to this collection action.
The FLSA collective action case was filed in October 2012. The Court entered an order conditionally certifying the collective action in December 2014. Notice was issued to the proposed nationwide class in March 2015, and the consent to join period has closed. The Court granted Defendants’ motion on partial summary judgment on whether the ABC plan complies with the FLSA. Plaintiffs appealed that decision to the Ninth Circuit Court of Appeals in May 2016. The case is currently pending on appeal in the Ninth Circuit.
