About this Case

Toby Marshall and Marc Cote of Terrell Marshall Law Group, PLLC represent current and former employees of Xerox Business Services, LLC and Affiliated Computer Services, Inc. (ACS) in two cases alleging Xerox and ACS did not pay their call center employees for all hours worked. In Douglas v. Xerox Business Services, LLC, TMLG represents Kristy Douglas, Tysheka Richard, and over 3,300 opt-in class members in this collective action for alleged violations of the Fair Labor Standards Act or FLSA.

Case Status

The FLSA collective action case was filed in October 2012. The Court entered an order conditionally certifying the collective action in December 2014. Notice was issued to the proposed nationwide class in March 2015, and the consent to join period has closed. The Court granted Defendants’ motion on partial summary judgment on whether the ABC plan complies with the FLSA. Plaintiffs appealed that decision to the Ninth Circuit Court of Appeals in May 2016. The case is currently pending on appeal in the Ninth Circuit.
